Terms of Service

These Terms of Service govern your access to and use of Pagete's website, software, member portal features, and related services. By accessing or using Pagete, you agree to these Terms.
Who These Terms Apply To
These Terms apply to:
- visitors to our website;
- customers that create and manage Pagete workspaces;
- staff users invited into a Pagete workspace; and
- end users who access a member portal or related services powered by Pagete.
If you use Pagete through a gym, studio, or other business, your relationship with that business may also be subject to separate terms, policies, or membership agreements.
Eligibility and Accounts
You must provide accurate information when creating an account or using the service. You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account;
- promptly updating inaccurate or outdated information; and
- using the service only as permitted by these Terms and applicable law.
We may suspend or restrict access if we believe an account is compromised, used unlawfully, or creates risk for Pagete or others.
Use of the Service
Subject to these Terms, Pagete grants you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business operations or, if applicable, for your personal use of a member portal.
You must not:
- use the service in violation of any law or regulation;
- interfere with or disrupt the security or operation of the service;
- access or attempt to access data that does not belong to you;
- reverse engineer, copy, scrape, or exploit the service except as allowed by law;
- upload or transmit malicious code, spam, or harmful content; or
- use Pagete to infringe the rights of others.
Customer Data
As between Pagete and the customer operating a workspace, the customer retains rights to the data it submits to the service, subject to the rights necessary for Pagete to host, process, back up, transmit, and display that data in order to provide the service.
Customers are responsible for:
- the lawfulness of the data they collect and store in Pagete;
- providing required notices and obtaining required consents from their members, staff, and customers; and
- their configuration choices, internal access controls, and instructions to Pagete.
Payments and Billing
Some features require a paid subscription or paid transactions. If you purchase a paid plan or other paid service:
- you agree to pay all applicable fees, taxes, and charges;
- billing may be handled by a third-party processor such as Stripe;
- subscription renewals may recur automatically unless cancelled; and
- except where required by law or stated otherwise, fees are non-refundable.
We may change pricing, packaging, or plan features prospectively. Material pricing changes will apply no earlier than the next billing cycle unless otherwise stated.
Availability and Changes
We may modify, update, suspend, or discontinue any part of the service from time to time. We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation.
Third-Party Services
The service may integrate with or rely on third-party providers. Your use of third-party services may be subject to those providers' separate terms and policies. Pagete is not responsible for third-party services we do not control.
Intellectual Property
Pagete and its licensors own the service, including software, branding, content, design, and related intellectual property, except for customer data and other content provided by users.
You may not use Pagete's name, trademarks, or branding without prior written permission, except to identify Pagete as the provider of the service.
Feedback
If you provide feedback, suggestions, or ideas about Pagete, we may use them without restriction or compensation to you.
Termination
You may stop using the service at any time. We may suspend or terminate access immediately if:
- you breach these Terms;
- payment obligations are overdue;
- use of the service creates security, legal, or operational risk; or
- we are required to do so by law.
Upon termination, your right to use the service ends. Provisions that by their nature should survive termination will survive, including provisions relating to payments due, intellectual property, disclaimers, limitations of liability, and dispute-related terms.
Disclaimers
To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. Pagete disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, error-free, or suitable for every use case.
Limitation of Liability
To the maximum extent permitted by law, Pagete and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities.
To the maximum extent permitted by law, Pagete's aggregate liability arising out of or relating to the service or these Terms will not exceed the amount paid to Pagete by the customer for the service in the 12 months before the event giving rise to the claim, or, if no fees were paid, USD 100.
Indemnity
You agree to defend, indemnify, and hold harmless Pagete and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses arising from:
- your use of the service;
- your content or data;
- your violation of these Terms; or
- your violation of applicable law or the rights of another person.
Governing Law
These Terms are governed by the laws applicable in Kuala Lumpur, Malaysia, excluding conflict of law rules. Any dispute arising from these Terms or the service will be subject to the exclusive jurisdiction of the courts located in Kuala Lumpur, Malaysia, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice where appropriate. Continued use of the service after the updated Terms take effect means you accept the revised Terms.
